International child abduction occurs, in the vast majority of cases, in conflictual relationships between couples of binational parents. Illicit transfer of a child” is defined as the departure of one of the parents with the child or children to a third country, to take up residence there without the consent of the other parent, who also has parental authority. <\/p>\n\n\n\n

In this brutal and stressful situation, I can help you enforce your rights as a parent and safeguard your child’s best interests, within the framework of a procedure for the return of an illegally displaced child. <\/p>\n\n\n\n

To this end, I am involved in filing complaints with the competent prosecuting authority, referring cases to the central authority, applying Council Regulation (EC) no. 2201\/2003 of November 27, 2003 (known as the “Brussels II bis Regulation”) concerning jurisdiction and the recognition and enforcement of judgments in matrimonial matters and the matters of parental responsibility, and implementing the Hague Convention of October 25, 1980 on the Civil Aspects of International Child Abduction.<\/p>\n<\/div>

Proceedings before United Nations bodies<\/h4>\n\n

At European level, the European Court of Human Rights remains the preferred supranational remedy for condemnation of the State concerned and compensation for any violation of fundamental rights, but other international bodies may also be called upon to deal with your case.<\/p>\n\n\n\n

Thus, the United Nations Human Rights Committee can receive any complaint of a violation of any of the rights set out in the International Covenant on Civil and Political Rights, under conditions similar to those for an application to the European Court of Human Rights.<\/p>\n<\/div>
